These General Terms and Conditions of Sale and Transport are subject to French law and apply to all commercial relations between ‘Chambord Montgolfière’ and any “customer” (natural or legal person placing an order or beneficiary of a ticket) or any ‘passenger’ travelling free of charge.
The terms and conditions of sale and service are fully accepted by the ‘customer’ or ‘beneficiary’ upon confirmation of the order. It is the responsibility of the ‘customer’ to ensure that the “beneficiary” or ‘beneficiaries’ have accepted these general terms and conditions of sale.
The service is subject to the GTC in force on the day of the flight. It is the responsibility of the ‘customer’ to check that they have not been modified between the dates of purchase and flight.
1 – Travel document
This ticket is non-transferable and corresponds to one seat on a hot air balloon flight.
It constitutes the contract between the ‘air carrier’ and the ‘customer’.
It must be presented before boarding.
It cannot be exchanged without the agreement of ‘Chambord Montgolfière’. It is non-refundable.
It is valid for two years from the date of issue.
2 – Prices and payment
Prices are quoted in Euros and are subject to change without notice.
The service includes:
The hot air balloon flight,
Transportation of passengers before and after the flight,
VAT (10%) and compulsory insurance.
3 – Rules
Tickets are issued after payment has been received.
Secure online payment in accordance with STRIPE terms and conditions.
4 – Flight date reservation
The flight date is selected via the passenger extranet. If this is not possible, it will be done by text message or email.
The ‘customer’ must provide their name(s), ticket number(s) and mobile phone number, and suggest five or six dates, specifying their preferences (morning or evening).
5 – Flight confirmation
The “customer” will be informed of the theft by text message and email:
– For a morning flight: the day before between 5:00 p.m. and 6:30 p.m.
– For an evening flight: on the day of travel between 12:00 p.m. and 1:30 p.m.
6 – Cancellations
By the ‘customer’: no penalty if cancellation occurs within 8 days prior to the flight date, or upon presentation of a document certifying a case of force majeure.
Outside of these cases and in the absence of the ‘customer’ at the scheduled time at the meeting point, the ticket will be considered used and will not be refunded.
By ‘Chambord Montgolfière’:
At any time, the pilot, who is the sole authority on board the aircraft, may decide to cancel a particular flight in order to:
– avoid compromising passenger safety,
– comply with aviation regulations.
For all these same reasons, a pilot may interrupt the flight at any time.
In the event of cancellation, the ticket will remain valid unless the flight has lasted more than 30 minutes.
7 – Boarding conditions
Medical contraindications: Bone fragility, lower limb prostheses, spinal disorders, pregnancy.
Any medical condition must be accompanied by a medical certificate of fitness to fly in a hot air balloon.
Anyone under the influence of drugs or alcohol will not be allowed to board and their ticket will be considered used.
Any false statements regarding the information provided on the booking form, particularly regarding passenger weight, may have a serious impact on flight safety, engaging the responsibility of the ‘customer’ and resulting in de facto exclusion without compensation.
Children may board from the age of 7. Until the age of 13, they must be accompanied by a responsible adult.
Regarding clothing, garments must be made of natural fibres (no synthetic fabrics). The torso, arms and legs must be covered, and closed shoes must provide good ankle support.
Chambord Montgolfière cannot be held liable for any failure to comply with these rules.
Only small cameras and video cameras in protective cases are permitted. Backpacks and handbags are not permitted.
Chambord Montgolfière cannot be held liable for any loss or damage.
8 – Insurance
The risks are covered for amounts comparable to those imposed by the Warsaw Convention of 1929 and in accordance with European Regulation 785/2004, which defines the insurance requirements applicable to aircraft operators. The insurance covers each ‘passenger’ under civil liability related to transport for remuneration, up to a limit in accordance with current regulations. Insurance for higher amounts may be taken out. Damage to objects, clothing, cameras, prosthetic devices (internal or external) is not covered.
9 – Transfer of service
The flight may be entrusted to another company also approved by the Civil Aviation Authority for passenger air transport.
10 – Right of withdrawal
As ‘Chambord Montgolfière’ holds an air carrier certificate, the provisions of Article L 121-18 of the Consumer Code do not apply in the context of passenger transport and exempt ‘Chambord Montgolfière’ from the provisions of the articles of the Hamon Law. The ‘customer’ therefore does not have the right of withdrawal.
11 – Data Protection Act
Personal data is used to process your order and is essential for your flight to take place. In accordance with the French Data Protection Act of 6 January 1978, the ‘customer’ has the right to access and rectify the data provided during the booking process. This data is not used for any other purpose.
12 – Disputes
In accordance with Article L. 152-1 of the French Consumer Code, you may use the MEDICYS mediation service, to which we belong, either electronically at ‘www.medicys.fr’ or by post at ‘MEDICYS, 73, Boulevard de Clichy 75009 Paris’.
